ARTeXTiNCT (“ARTeXTiNCT,” “we” or “our”) provides a service for viewing and purchasing digital works of art through our website, accessible at https://art.extinct.at/ (the “Site”). These Terms, govern your access to and use of the Services, and constitute a binding legal agreement between you and ARTeXTiNCT. IF YOU DO NOT AGREE TO THESE TERMS AND THE PRIVACY POLICY, THEN YOU HAVE NO RIGHT TO ACCESS OR USE THE SERVICES.

We reserve the right to change the URL, modify or discontinue, and restrict or block access to, the Services without notice to you. We may modify or remove any Works of Art, ARTeXTiNCT Content from the Services at any time without notice to you.

The Services are intended solely for persons who are 18 or older.

every print is a single edition print. when someone purchases it, it will automatically be removed from the listing.

original digital files are not included in the purchase

ARTeXTiNCT reserves the right to cancel any order for an Original Work of Art or Printed Work placed via the Services if ARTeXTiNCT determines, in its reasonable discretion, that the item is mispriced, out of stock, discontinued, or otherwise unavailable at the price listed via the Services. If ARTeXTiNCT cancels an order placed via the Services, ARTeXTiNCT will send you an email confirmation of such cancellation and you will not be charged for your order.

You understand and agree that ARTeXTiNCT tries to display colors of Digital Works of Art accurately. However, because individual computer monitors may display colors differently, ARTeXTiNCT is not responsible for the color accuracy of any Digital Works displayed on the Services, and disclaims all liability in this regard.

You also understand and agree that uploaded images on the site are of reduced resolution than the original image that will be printed. to give some perspective, uploaded images are restricted to a resolution of 1000x1000 (10 mega-pixels) while original image may be up to 9000x9000 (81 mega-pixels)

Returns and cancellations

you may cancel your order at any stage, provided we have not initiated production for your order or dispatched the relevant products to you or your customer. To do this you must notify us in writing at the address above or by sending an email to art@extinct.at within the first day -max 2 days- of your submited order.

we do not accept returns. all sales are non-refundable. if there is a defect with the product upon delivery, please contact us.

pricing

You may purchase Printed Works that are listed on the Services. product prices are final and include everything: printing, packaging, shipping, and tax.

packaging

All prints are robustly packaged. All framed and canvas prints are wrapped in a protective sleeve with individual plastic or cardboard guards added to each corner. Additional cardboard is secured over the print surface to minimise the risk of breakages or transit damage. Each print is then shipped in a heavy duty cardboard box. packaging costs are included in the product price.

There may be different shipping and courier options available depending on the country and product type. Printed Works will be shipped directly to your provided address within 1-7 days depending on destination. shipping costs are included in the product price.

This privacy policy (“Privacy Policy”) describes how information and data is collected from you when you use this online website, mobile website, application, digital service, or any related products, services, sites, features or functionality (each a “Service”, collectively the “Services”) that link to this Privacy Policy, and how eXTiNCT (“we”, “us”, or “our”), uses, shares and manages your information and data. By using any of the Services, you consent to the collection, use, processing, and sharing of your information as described in this Privacy Policy.

We are committed to recognizing and respecting your privacy rights by keeping you informed and processing and protecting your personal data in compliance with applicable data protection laws and regulations (“Data Protection Laws”).

ARTeXTiNCT does not use cookies, but we use google analytics which installs cookies. See relevant privacy policy for google analytics. We collect shipping Data You Directly and Voluntarily Provide to Us such as your Name, Email Address, Phone Number. Shipping information is shared ONLY with our third-party print-on-demand and shipping service provider (PRODIGI).

If you make a purchase through the Services, you will pay using stripe a third-party payment service. Billing information collected by stripe, is not available to us. Only shipping information collected by stripe, is available to us. Information collected from you by stripe, is governed by the applicable third-party payment service’s privacy policy. You should review the applicable privacy policy prior to submitting any information to the applicable third-party payment service.

When you successfully complete an order, we will email you about your order details. Other than that, we WILL NOT USE your provided information to send you emails, sms or calls of any sort unless you have subscribed to our newsletter.
